Combating Counterfeiting

The Problem

It is estimated that counterfeits cost the global economy an estimated $500 billion each year and at least 750,000 lost jobs.  Counterfeiting includes, but goes way beyond, fake ROLEX® watches or bogus POLO® shirts.  In fact, no brand is safe, including many types of counterfeit products the may cause serious harm to the health and/or safety of the public.  For example, it is estimated that close to $83 billion worth of counterfeit drugs are sold annually.  Billions of dollars of losses are also felt in other industries as diverse as apparel, alcohol, tobacco, auto parts, and electronics.

The Solution

Counterfeiting is insidious, and counterfeiters and their fake merchandise, are typically difficult to locate and remove from the marketplace.  Companies should consider the impact of counterfeiting on the goodwill associated with their brand and the other negative consequences for their businesses.

We collaborate with you to develop strategies to combat this problem to protect your brand and goodwill.  We have extensive experience in developing and implementing innovative approaches to combat counterfeiting and enforcing intellectual property rights, including working with highly trained investigators and state and federal prosecutors to bring these criminals to justice.

  • Conducted an ex parte seizure on behalf of a leading tanning salon software company and obtained an asset freeze, monetary award, and permanent injunction to stop counterfeit software.

  • Conducted an ex parte seizure on behalf of a leading cosmetic company and obtained an asset freeze, monetary award, and permanent injunction to stop counterfeit nail polish.

  • Conducted an ex parte seizure on behalf of a luxury apparel brand and obtained an asset freeze, monetary award, and permanent injunction to stop counterfeit wrap dresses.

  • Conducted an ex parte seizure on behalf of a luxury apparel brand and obtained an asset freeze, monetary award, and permanent injunction to stop counterfeit wrap dresses.

  • Conducted an ex parte seizure on behalf of a luxury design house and obtained an asset freeze, monetary award, and permanent injunction to stop counterfeit purses, wallets, ties, scarfs, and other related accessories.  

  • Performed successful trademark anti-counterfeiting campaigns utilizing both civil and criminal statutes of behalf of luxury watch manufacturers, high-end clothing manufacturers and retailers, and manufacturers of professional cosmetic products, seizing counterfeit goods, obtaining preliminary and permanent injunctive relief, as well as damages and attorneys’ fees.
